OVERVIEW

Welcome to Barbarian Apparel.

The terms “Barbarian Apparel,” “we,” “us,” and “our” refer to Barbarian Apparel. We operate this website and online store, including all related information, content, features, tools, products, custom apparel services, team stores, and other services offered through the website (collectively, the “Services”).

Our online store is powered by Shopify, which provides the ecommerce platform that allows us to offer products and services to you.

These Terms of Service (“Terms”) describe your rights and responsibilities when using our Services or purchasing products from Barbarian Apparel.

By visiting our website, using our Services, submitting an order, approving custom artwork, or purchasing from Barbarian Apparel, you agree to these Terms and our Privacy Policy.

If you do not agree to these Terms, you should not use our Services or place an order.

SECTION 1 – ELIGIBILITY AND ACCOUNT INFORMATION

By using our Services, you represent that you are at least the age of majority in your state of residence or are using the Services with the permission of a parent or legal guardian.

You agree to provide current, complete, and accurate information when placing an order or creating an account.

You are responsible for maintaining the confidentiality of your account information and for activity occurring through your account.

SECTION 2 – PRODUCTS

Barbarian Apparel offers products that may include custom wrestling singlets, fight shorts, compression apparel, shirts, hoodies, warmups, bags, headgear, team apparel, event merchandise, and other athletic apparel and accessories.

We make reasonable efforts to accurately display our products, colors, designs, and product details.

However, colors displayed on a computer, tablet, or phone may differ from the actual finished product because of differences in screen settings, materials, fabric, printing processes, sublimation processes, dye lots, and manufacturing.

Small differences between digital mockups and finished products are normal and are not considered manufacturing defects.

Product descriptions, specifications, designs, pricing, availability, and other information may be changed at any time without notice.

We reserve the right to discontinue products or limit quantities at our discretion.

SECTION 3 – CUSTOM PRODUCTS

Many products sold by Barbarian Apparel are custom-made specifically for an individual, team, club, school, organization, or event.

Custom products may include, but are not limited to:

  • Custom wrestling singlets
  • Custom shorts
  • Custom compression shirts
  • Custom team apparel
  • Personalized garments
  • Garments containing names or numbers
  • Custom logos or artwork
  • Event-specific merchandise
  • Team store products

Because these products are manufactured specifically for the customer, custom products generally cannot be canceled, returned, exchanged, or refunded after production has begun, except where Barbarian Apparel determines that the product contains a manufacturing defect or an error caused by Barbarian Apparel.

SECTION 4 – ARTWORK AND DESIGN APPROVAL

For custom orders, Barbarian Apparel may provide digital artwork, mockups, proofs, or other representations of the proposed product.

The customer is responsible for carefully reviewing all artwork before approval.

This includes reviewing:

  • Spelling
  • Names
  • Numbers
  • Logos
  • Colors
  • Placement
  • Garment style
  • Design layout
  • Quantities
  • Other requested customization

Once artwork is approved, the customer authorizes Barbarian Apparel to proceed with production.

Barbarian Apparel is not responsible for errors that appeared on artwork approved by the customer.

Changes requested after artwork approval may not be possible and may result in additional charges or production delays.

Digital artwork is intended to provide a reasonable representation of the finished product. Minor differences between a digital rendering and the manufactured garment are normal.

SECTION 5 – CUSTOMER-PROVIDED LOGOS, TRADEMARKS AND ARTWORK

Customers frequently provide Barbarian Apparel with school logos, club logos, team names, mascots, sponsor logos, trademarks, photographs, graphics, artwork, names, and other materials for use on custom apparel.

By submitting any such material to Barbarian Apparel, you represent and warrant that you own the material or have obtained all necessary rights, licenses, permissions, and authorizations required for Barbarian Apparel to reproduce and use the material for your order.

You authorize Barbarian Apparel and its manufacturing partners to reproduce, modify, resize, arrange, print, embroider, sublimate, manufacture, and otherwise use the submitted material as necessary to complete your order.

Barbarian Apparel is not responsible for determining ownership of customer-provided artwork or determining whether a customer has received permission to use a particular logo, name, image, trademark, or other intellectual property.

You agree to be responsible for claims resulting from materials you provided to Barbarian Apparel without proper authorization.

Barbarian Apparel reserves the right to refuse any design or artwork request at its discretion.

SECTION 6 – BARBARIAN APPAREL ARTWORK

Unless otherwise agreed in writing, artwork, design concepts, templates, patterns, mockups, layouts, and other creative materials created by Barbarian Apparel remain the intellectual property of Barbarian Apparel.

Purchasing garments from Barbarian Apparel does not automatically transfer ownership of the underlying artwork, templates, production files, or design elements.

Customers may not reproduce, distribute, provide to another manufacturer, or commercially use Barbarian Apparel-created artwork without our written permission.

Customer-owned logos and intellectual property remain the property of their respective owners.

SECTION 7 – SIZING

Customers are responsible for selecting the appropriate garment size.

Barbarian Apparel may provide size charts, recommendations, or general sizing guidance as a convenience. These recommendations are estimates and cannot guarantee a particular fit because body types, fit preferences, garment construction, and individual measurements vary.

A customer selecting an incorrect size is not considered a manufacturing defect.

Custom and personalized garments generally cannot be exchanged solely because the customer selected the wrong size.

Customers should review the applicable size chart before ordering.

SECTION 8 – TEAM STORES

Barbarian Apparel may create online team stores for schools, wrestling clubs, organizations, events, teams, or other groups.

Team stores may operate for a limited ordering period and may have a published closing date.

Orders generally cannot be added, modified, or canceled after the team store closes and production begins.

Production times for team store orders generally begin after the store closes rather than on the date an individual customer places an order.

Certain products may require minimum order quantities.

If a product does not meet a required minimum quantity, Barbarian Apparel may, at its discretion:

  • Cancel and refund the affected item;
  • Offer an alternative product;
  • Contact the team representative regarding available options; or
  • Make another reasonable accommodation.

Products containing personalized names, numbers, or other custom information are final sale unless Barbarian Apparel made an error in producing the personalization.

SECTION 9 – ORDERS

Submitting an order constitutes an offer to purchase products or services from Barbarian Apparel.

We reserve the right to accept, reject, modify, or cancel an order at our discretion.

Orders are not considered accepted until payment has been successfully processed and Barbarian Apparel has accepted the order.

For custom products, production may also depend upon final artwork approval.

Customers should carefully review their order before submitting it.

Once custom production has begun, changes or cancellations may not be possible.

If Barbarian Apparel cancels an order after payment, the applicable amount will be refunded.

SECTION 10 – PRICES AND PAYMENT

Prices are subject to change without notice.

The price charged will generally be the price in effect when the order is placed unless otherwise agreed in writing.

Unless expressly stated otherwise, prices may not include applicable:

  • Sales tax
  • Shipping charges
  • Handling charges
  • Customs charges
  • Duties
  • Import fees
  • Other government-imposed charges

Promotional pricing may be subject to separate rules or expiration dates.

Customers agree to provide accurate payment and billing information and represent that they are authorized to use the payment method provided.

SECTION 11 – PRODUCTION TIMES

Production times provided by Barbarian Apparel are estimates unless Barbarian Apparel expressly guarantees a specific deadline in writing.

Production time and shipping time are separate.

Production may be affected by factors including:

  • Artwork approval delays
  • Customer-requested changes
  • Product availability
  • Manufacturing capacity
  • Material availability
  • Factory closures
  • Holidays
  • Shipping disruptions
  • Customs delays
  • Weather
  • Labor disruptions
  • Events outside our reasonable control

Barbarian Apparel will make reasonable efforts to complete orders within estimated production windows but does not guarantee delivery by a particular date unless specifically agreed to in writing.

Customers with a firm event or competition deadline should communicate that deadline before approving the order.

SECTION 12 – SHIPPING AND DELIVERY

Shipping and delivery dates are estimates unless expressly guaranteed in writing.

Once an order leaves Barbarian Apparel or our manufacturing facility, delivery may be affected by the shipping carrier and circumstances outside our control.

Barbarian Apparel is not responsible for carrier delays, weather delays, incorrect addresses supplied by the customer, customs delays, or other shipping disruptions outside our reasonable control.

Customers are responsible for providing a complete and accurate shipping address.

Additional shipping charges resulting from an incorrect address or requested rerouting may be charged to the customer.

If tracking shows a shipment as delivered but the customer cannot locate the package, the customer should contact the carrier and Barbarian Apparel promptly so that available options can be reviewed.

SECTION 13 – INSPECTION OF ORDERS

Customers should inspect merchandise promptly after receiving it.

Any suspected manufacturing defect, incorrect product, incorrect personalization, shortage, or other order issue should be reported to Barbarian Apparel as soon as reasonably possible after delivery.

Customers may be asked to provide photographs or other information so we can evaluate the issue.

Barbarian Apparel will determine, in its reasonable discretion, whether an item qualifies as defective or incorrect.

Depending upon the circumstances, available remedies may include replacement, repair, store credit, refund, or another reasonable resolution.

Normal wear, improper washing, misuse, damage occurring after delivery, incorrect sizing selected by the customer, and minor variations inherent to custom manufacturing are not considered manufacturing defects.

SECTION 14 – RETURNS, REFUNDS AND EXCHANGES

Returns, refunds, and exchanges are governed by the Barbarian Apparel Refund Policy.

Custom-made, personalized, name-printed, number-printed, or otherwise customized products are generally final sale unless the item is defective or Barbarian Apparel made an error.

Non-custom products may be eligible for return or exchange according to our Refund Policy.

Customers should review the Refund Policy before placing an order.

SECTION 15 – CARE OF GARMENTS

Customers are responsible for following applicable washing, drying, and care instructions.

Damage caused by improper washing, excessive heat, bleaching, ironing, misuse, alteration, or failure to follow care instructions is not considered a manufacturing defect.

Athletic garments are subject to normal wear from training, competition, contact, mat surfaces, Velcro, equipment, and repeated washing.

Normal wear and tear is not covered as a manufacturing defect.

SECTION 16 – INTELLECTUAL PROPERTY

The Barbarian Apparel website and Services, including logos, trademarks, artwork, graphics, photographs, videos, product designs, text, layouts, website content, slogans, and other materials owned by Barbarian Apparel are protected by applicable copyright, trademark, and other intellectual property laws.

Barbarian Apparel names, logos, designs, slogans, and related branding may not be copied or used without our prior written permission.

Nothing in these Terms grants customers ownership or licensing rights in Barbarian Apparel intellectual property except as expressly agreed in writing.

Third-party names, logos, and trademarks remain the property of their respective owners.

SECTION 17 – PHOTOGRAPHY AND DISPLAY OF WORK

Unless otherwise agreed in writing, Barbarian Apparel may photograph or display completed custom products, mockups, or designs for purposes such as our portfolio, website, social media, samples, marketing, and promotion.

This does not transfer ownership of a customer's trademarks or logos to Barbarian Apparel.

If an organization requires its custom designs to remain confidential or not be used for promotional purposes, it should notify Barbarian Apparel in writing before production.

SECTION 18 – OPTIONAL THIRD-PARTY TOOLS

Our Services may include tools, applications, payment systems, plugins, or other services operated by third parties.

Such third-party services may be provided “as is” and “as available.”

Barbarian Apparel does not control all third-party services and is not responsible for problems caused solely by third-party platforms.

Customers should review any applicable third-party terms and privacy policies.

SECTION 19 – THIRD-PARTY LINKS

Our website may contain links to websites or services operated by third parties.

Barbarian Apparel is not responsible for the content, accuracy, security, products, services, policies, or practices of third-party websites.

Accessing a third-party website is done at the user's own discretion.

SECTION 20 – SHOPIFY

Barbarian Apparel's online store is powered by Shopify.

Purchases made through our store are transactions directly between the customer and Barbarian Apparel.

Shopify provides ecommerce technology and services but is not the seller of Barbarian Apparel products.

SECTION 21 – PRIVACY

Personal information collected through our Services is handled according to our Privacy Policy.

Because our store is hosted through Shopify, certain information may also be collected and processed by Shopify and other service providers used to operate our ecommerce business.

Customers should review our Privacy Policy for additional information.

SECTION 22 – REVIEWS, FEEDBACK AND CUSTOMER CONTENT

If you submit reviews, photographs, comments, suggestions, ideas, testimonials, or other content to Barbarian Apparel, you grant Barbarian Apparel permission to use, reproduce, publish, display, and distribute that content for reasonable business and promotional purposes unless otherwise prohibited by law.

You represent that you have the right to submit such content and that your submission does not violate another person's rights.

You remain responsible for content you submit.

SECTION 23 – ERRORS AND INACCURACIES

Occasionally, our website may contain errors involving product descriptions, pricing, promotions, shipping charges, availability, specifications, or other information.

We reserve the right to correct errors, update information, and cancel or modify orders affected by material errors, subject to applicable law.

SECTION 24 – PROHIBITED USES

You may not use our Services:

  • To violate applicable laws or regulations;
  • To infringe intellectual property rights;
  • To submit fraudulent or misleading information;
  • To interfere with operation or security of the Services;

We may suspend or terminate access to our Services where reasonably necessary, including for violations of these Terms, suspected fraud, abuse, nonpayment, unlawful conduct, or misuse of our Services.

Obligations that by their nature should survive termination will continue after termination, including provisions concerning intellectual property, payment obligations, disclaimers, indemnification, and limitations of liability.

SECTION 26 – DISCLAIMER OF WARRANTIES

To the fullest extent permitted by applicable law, the website, Services, and products are provided on an “as is” and “as available” basis except for warranties expressly provided by Barbarian Apparel.

We do not guarantee that our website will always operate without interruption or error.

Nothing in these Terms eliminates warranties or consumer rights that cannot legally be excluded.

SECTION 27 – LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Barbarian Apparel and its owners, officers, employees, contractors, manufacturers, suppliers, affiliates, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from the use of our Services or products.

This may include lost profits, lost revenue, lost opportunities, loss of data, or similar damages.

Nothing in these Terms excludes liability that cannot legally be excluded or limited.

SECTION 28 – INDEMNIFICATION

To the fullest extent permitted by law, you agree to indemnify and hold harmless Barbarian Apparel and its owners, officers, employees, contractors, affiliates, manufacturers, service providers, and licensors from third-party claims, damages, losses, liabilities, and reasonable legal expenses arising from:

  1. Your violation of these Terms;
  2. Your violation of applicable law;
  3. Your violation of another person's intellectual property or other legal rights; or
  4. Artwork, trademarks, logos, photographs, names, graphics, or other materials you provided to Barbarian Apparel without proper authorization.

SECTION 29 – FORCE MAJEURE

Barbarian Apparel will not be responsible for delays or failure to perform caused by circumstances beyond our reasonable control.

Such events may include natural disasters, severe weather, fire, flood, war, terrorism, civil unrest, pandemics, government restrictions, labor disruptions, transportation interruptions, power failures, material shortages, factory closures, customs delays, shipping carrier disruptions, or similar events.

We will make reasonable efforts to complete affected orders as circumstances permit.

SECTION 30 – SEVERABILITY

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the fullest extent permitted by law and the remaining provisions will continue in effect.

SECTION 31 – WAIVER AND ENTIRE AGREEMENT

Failure by Barbarian Apparel to enforce any provision of these Terms does not waive our right to enforce that provision later.

These Terms, together with our Privacy Policy, Refund Policy, and other policies expressly incorporated into them, constitute the agreement governing use of our Services unless a separate written agreement between Barbarian Apparel and the customer provides otherwise.

SECTION 32 – ASSIGNMENT

Customers may not transfer their rights or obligations under these Terms without prior written permission from Barbarian Apparel.

Barbarian Apparel may assign or transfer its rights and obligations as permitted by applicable law.

SECTION 33 – GOVERNING LAW

These Terms and transactions with Barbarian Apparel will be governed by the laws of the State of Ohio, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Any dispute will be handled in an appropriate court having jurisdiction over Barbarian Apparel, subject to applicable law.

SECTION 34 – CHANGES TO THESE TERMS

We may update these Terms periodically.

The current version will be posted on our website along with the applicable effective or last-updated date.

Material changes will become effective as permitted by applicable law.

Continued use of the Services after updated Terms become effective constitutes acceptance of the revised Terms where permitted by law.
